We will use your Personal Information, including, without limitation, for the following purposes: (i) allow you to create an account; (ii) to provide you the products and services and to process your requests; (iii) communicate with you about your use of the products and services and for support purposes; (iv) fulfill any instruction and/or request made by you in the context of the products and services; (v) to personalize your experience with our products and services; and (vi) to generally administer and improve our products and services.

b. To allow you to make use of our Website. Why is Personal Information collected and for what purposes? To allow you to be a “dealer” of Haifa products and services; to display your Personal Information on our Website as a “dealer”, and to send you contact details of farmers and other end-users who are interested in purchasing our products.

(v) When you are a grower and/or an end-user and provide us with your Personal Information (e.g., contact details)

Why is Personal Information collected and for what purposes? To provide our products and services; to fulfill your requests; to fulfil the applicable agreement; to communicate with you for service-related communications; and to allow you to contact a “dealer” of Haifa products and services.

Legal basis (only, if applicable under your jurisdiction) – Processing is necessary for the performance of a contract to which our customer is a party; compliance with a legal obligation (e.g. tax laws, bookkeeping laws, etc.); and legitimate interest (e.g. send you contract-related communications).
Consequences of not providing the Personal Information: We cannot (i) provide the services and/or our products; (ii) fulfil the agreement; and (iii) communicate with you.

However, financial information may be required to perform an agreement, such as banking information (in the case of our customers) and consideration for the contract (in the case of providers, suppliers, and developers).

2. How We Protect and Retain Your Personal Information

2.1. Security. The privacy and protection of your information is important to us. We will use commercially reasonable efforts to protect your Personal Information. We have implemented appropriate technical, organizational and security measures designed to protect your Personal Information. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device, or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

2.2. Retention of your Personal Information. Your Personal Information will be stored until we delete the record and we proactively delete it or you send a valid deletion request, please note that in some circumstances we may store your Personal Information for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Information or dealings. 3. How We Share Your Personal Information

3.1. In addition to the recipients described above, we may share your Personal Information as follows:

3.1.1. With our business partners with whom we jointly offer products or services (including distributors). We may also share Personal Information with our affiliated companies. We may also share Personal Information with our affiliated companies about you. They may combine this Personal Information with other details they hold about you. Unless they provide you with their own privacy policy, they may use your Personal Information for the purposes explained in this Privacy Policy. We are part of the Haifa group, which is a global organization. For the purposes explained in this Privacy Policy, we may transfer your Personal Information to Haifa group companies (including service providers operating on their behalf) and other third parties in countries which do not have the same level of data protection laws as those in the country where you are located. Haifa uses several legal mechanisms, including EU Standard Contractual Clauses, to help ensure that your rights and protections are respected by all companies of the Haifa group. We use efforts to ensure that each Haifa group company will comply with the key data protection principles of fair handling of Personal Information and ensuring adequate level of protection of Personal Information.

3.1.2. We may use third party service providers to process your information for the purposes outlined above, including, without limitation:
3.1.2.1. With cloud service providers for hosting purposes;
3.1.2.2. With websites and web content creation platforms in order to help us manage our Website, Web Apps and Mobile App;
3.1.2.3. With email providers, marketing and advertising providers, CRM, other similar tools and providers;
3.1.2.4. With payment processing service providers, for billing purposes;
3.1.2.5. With third parties integration services that we make available Web Apps and Mobile App; and
3.1.2.6. With analytic companies, in order to help us understand and analyze information we collect in accordance with this policy.

3.1.3. To the extent necessary, with regulators, courts or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order;

3.1.4. If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your Personal Information to such third party (whether actual or potential) in connection with the foregoing events;

3.1.5. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Information in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company; and/or

3.1.6. Where you have provided your consent to us sharing or transferring your Personal Information (e.g., where you provide us with marketing consents or to optional additional services or functionality).

4. Additional Information Regarding Transfers of Personal Information

4.1. Internal transfers: Transfers within the Haifa group will be covered by an internal processing agreement entered into by members of the Haifa group (an intra-group data processing agreement) which contractually obliges each member to ensure that Personal Information receives an adequate and consistent level of protection wherever it is transferred to.

4.2. External transfers: Where we transfer your Personal Information outside of EU/EEA (for example to third parties who provide us with services), we will generally obtain contractual commitments from them to protect your Personal Information.

4.3. Transfer mechanism: When Haifa group engages in such transfers of Personal Information, it relies on i) Adequacy Decisions as adopted by European Commission on the basis of Article 45 of Regulation (EU) 2016/679 (GDPR) (for example, when we access from Israel), or ii) Standard Contractual Clauses issued by the European Commission. Haifa Group also continually monitors the circumstances surrounding such transfers in order to ensure that these maintain, in practice, a level of protection that is essentially equivalent to the one guaranteed by the GDPR.

5. Your Privacy Rights. How To Delete Your Account

5.1. The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR, or LGPD – as applicable):

You have a right to access Personal Information held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;
You have the right to request that we rectify any Personal Information we hold that is inaccurate or misleading;
You have the right to request the erasure/deletion of your Personal Information (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Information, for example for the establishment, exercise or defense of legal claims;
You have the right to object, to or to request restriction, of the processing;
You have the right to data portability. This means that you may have the right to receive your Personal Information in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
You have the right to object to profiling;
You have the right to withdraw your consent at any time. Please note that there may be circumstances in which we are entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations. Also, please note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;

You have the right to know whether your Personal Information is sold or disclosed and to whom;
You have the right to restriction of, or object to, processing of your Personal Information, including the right to opt in or opt out of sale of your Personal Information to third parties, if applicable, where such requests are permitted by law;
You have the right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA; and/or
You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence (e.g. the Attorney General in your State). We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution. You have certain choices about your Personal Information. Where you have consented to the processing of your Personal Information, you may withdraw that consent at any time and prevent further processing by contacting us as described in this Privacy Policy. Even if you opt out, we may still collect and use non-Personal Information regarding your activities on our services and for other legal purposes as described above. 5.4. Deleting your account: Should you ever decide to delete your account, you may do so by emailing privacy@haifa-group.com. If you terminate your account, any association between your account and Personal Information we store will no longer be accessible through your account. However, given the nature of sharing on certain services, any public activity on your account prior to deletion will remain stored on our servers and will remain accessible to the public.

5.5. Marketing emails – opt-out: You may choose not to receive marketing email of this type by sending a single email with the subject "BLOCK" to privacy@haifa-group.com. Please note that the email must come from the email account you wish to block OR if you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt.

6. Use by Children.

We do not offer our products or services for use by children and, therefore, we do not knowingly collect Personal Information from, and/or about children under the age of eighteen (18). If you are under the age of eighteen (18), do not provide any Personal Information to us without involvement of a parent or a guardian. For the purposes of the GDPR, we do not intend to offer information society services directly to children. In the event that we become aware that you provide Personal Information in violation of applicable privacy laws, we reserve the right to delete it. 8. Analytic Tools.

Google Analytics. The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the information collected through the use of Google Analytics with Personal Information we collect. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. During the 12-month period prior to the Last Updated date of this Privacy Policy, we may have disclosed your Personal Information with certain categories of third parties as described above in Section 1 and 3.
